AiTradeStore – Terms of Use

Welcome to AiTradeStore (referred to as “Company,” “we,” or “our”). We provide web interfaces and APIs for hosting, using, fine-tuning, and training large AI models (collectively, the “Services”). We may also offer professional services, such as training or migration support (“Support”).

These Terms of Use (the “Agreement”) govern your access to and use of our website at https://aitradestore.com/ (the “Site”), our Services, and any Support we provide. By using them, you agree to be bound by this Agreement. It becomes effective from your first use and may be updated in the future.

1. Service Overview

You are granted a limited right to use our Services, including access to APIs, tokens, HTML scripts, and other tools. You are responsible for managing your user accounts and ensuring compliance with this Agreement.

We may modify or discontinue parts of the Services and do not guarantee uptime or availability unless stated otherwise in a separate agreement. We protect your data from unauthorized access and may monitor usage to ensure compliance and improve the Services.

2. User Requirements

You must be at least 13 years old (or meet the minimum age required in your country). If you are under the legal age of majority, you must have consent from a parent or guardian.

You are responsible for keeping your login credentials secure and notifying us of any security breaches. You are liable for all content and data you upload to the Services.

Do not upload financial, health, or sensitive personal information. You must not use the Services to distribute illegal or harmful content.

3. Professional Services

Professional services may be provided under a separate order. You must provide all necessary materials and access. We will only use them to deliver the agreed services.

4. Payments

You agree to pay fees according to our current pricing (listed on the Site or in a separate agreement). Payments are made automatically through your selected payment method. Payments are non-refundable unless explicitly stated. Failure to pay within 5 days may result in suspension of access.

All fees are exclusive of taxes — you are responsible for paying any applicable taxes.

5. Intellectual Property

We retain all rights to the Services, including the Site, API, and any results of professional services. You retain ownership of your data.

If you use third-party models, you must comply with their respective licenses. In case of a conflict, the third-party model license takes precedence.

7. Confidentiality and Restrictions

Unless otherwise agreed in writing, no confidentiality obligations apply. You must not:

• Reverse engineer or probe the Services;

• Build a competing product using our Services;

• Resell or share access to the Services;

• Exceed API rate limits or overload the system;

• Introduce malicious code;

• Use the Services in violation of any law.

8. Warranties and Disclaimers

We warrant that the Services will function according to documentation, and that professional services will be performed properly. If not, we will work to fix the issue.

All other warranties are disclaimed. We are not responsible for the accuracy of results, availability of third-party integrations, or any losses caused by your use of the Services.

9. Indemnification

We will defend you from third-party claims alleging that the Services infringe their IP, provided you:

• Notify us promptly;

• Allow us to control the defense;

• Cooperate fully.

10. Limitation of Liability

Except for gross negligence or IP violations, neither party is liable for indirect damages. Total liability is limited to the amount paid by you over the past 12 months.

11. General Terms

This Agreement remains in effect until you stop using the Site and Services. Some sections (like Payment and IP rights) survive termination.

You may not assign your rights under this Agreement without written consent, except in case of a business transfer. This Agreement is governed by the laws of the State of California (excluding conflict of laws principles).

No waiver is valid unless in writing. This Agreement does not create a legal partnership. It is the full agreement between you and the Company.

We are not liable for delays or failures caused by force majeure events such as natural disasters, cyberattacks, or war.
